My girlfriends parents have decided that they would rather her sit at home in her room and cry night after night, rather than let her spend time with myself and my family. they say they don' t "dislike" me yet they have started making these rules such as...only allowing her to visit me on days that she has to work so that she really has no time to visit me. She made the decision a few weeks ago to leave her house to get away from the immature games that her "adult" parents are playing. They have made threats to her and myself that if she does leave home and come here to stay that she and I both will go to jail. Is there a Law that can cause either of us to be put in jail. Shes 18, shes unhappy and feels unsafe at home so what could either of us get arrested for. I wont be kidnapping her or anything so if anyone can help me with this It would be GREATLY appreciated.

In the philippines, any person 18 years of age is legally an adult and may do what he wants. When it comes to marriage, however, parental consent is an indispensable requirement, which means one can't marry until permitted by his parents. If he reaches 22, parental consent is no longer necessary.

Here's more from the Faily Code of the Philippines:

Art. 234. Emancipation takes place by the attainment of majority. Unless othrwise provided, majority commences at the age of eighteen years.

Art. 236. Emancipation for any cause shall terminate parental authority over the person and property of the child who shall then be qualified and responsible for all acts of civil life, save the exceptions stablished by existing laws in special cases.

This all depends on where you are, you really should consult local laws and also ask for legal advise on the matter to be sure of your standing.

But most likely:

An 18 year old is an adult so the parents are very unlikely to have any legal say in the matter.

Especially if she has other accommodation worked out (then the homeless card won't work) although there is still a power imbalance and some idiot somewhere in the legal system may prefer to take the side of the older person.

I'd also want to determine if the threats that are being made might be illegal (though it'll be hard to prove, unless they try to make good on their threat in which case it might be them that go to jail), from what you've described her parents are clearly in the wrong to be threatening jail for something like that and seem to be controlling parents that don't deserve the title.

If you're both 18 there is no problem. The parents could always lie about... well anything... and have you arrested. She cannot be forcibly kept at home if she is 18. That is actually kidnapping. She has a right to travel and nobody is allowed to violate this right without due process of law.

Her PARENTS are not the IMMATURE ONES.

If she is so unhappy, then she should leave home... and then SHE will be the one responsible for RUINING HER OWN LIFE...

OH... that's right... you have such a great JOB that you can take care of her and the baby... RIGHT.!... I can imagine what your great job is... and I'D LIKE ONIONS ON THAT TOO.

Yes, she can leave home and will not be put in jail. It is not a crime.
