there are a bunch of kids in my neighborhood that are always coming on my front lawn and sometimes climb on our tree. they have no respect at all for our property. we do not have any children here so there is no reason for them to come on my property for anything. we are working on getting a fence around the property. until we do......is that considered trespassing and if i call the cops will they actually do anything about it?

there are usually about 5-10 kids, the age range is 6-12 and they have scratched up my vehicle that is in my driveway.

Yes, it is trespass and if you do not take steps to stop or prevent it, you may be held responsible for maintaining what is termed an attractive nuisance (the tree) and held liable for an injury when one of the children falls from it.

Whatever happened to kids being kids and responsible for their own actions?

I completely understand your situation. I lived this situation for YEARS. I grew up in a neighborhood where the young neighbors had no sense of boundaries. It's really frustrating because most people want to escuse their behavior because "they are just kids." These kids were just out of control and they had no reason to come over to our yard. They treated everyone's property as if it were their own, actually caused physical damage to my parents' expensive landscaping and would leave their personal belongings on our yard. They'd set off fireworks and leave the trash resulting from that all over our yard. It got to the point where my folks spent a ton of money to build a new fense around the yard that these kids could not climb over. But, now they throw water bottles and trash over the fense. It's a tough situation to be in because the police won't do much since "they're just kids", the parents take it personally when you ask them to keep their kids off your yard (thereby ruining your friendly neighbor relations), the kids are probably more likely to do things to taunt you once they find out you're bothered by their presence and the moment you call the cops on your neighbors, they'll be inclined to make your life more difficult. It's a frustrating situation to be in.

It depends on the age of the kids and their motive for being on your front lawn. If they are just playing around on the street and wander onto your property, they likely mean no harm. It probably never dawns on them that they don't belong there.

Making enemies of the kids and/or their parents is seldom a good idea. The parents will snub you and the kids, once you have that fence erected, will single your house out. You may find things being hurled over the fence, which will be a lot more annoying than having the youngsters play on your front lawn now.

Why not bide your time. Once the fence is in place, the problem will subside or or cease altogether.

They are trespassing if you have asked them to not be on your lawn (by means of signs, verbal warnings, a fence, etc) and they continue to climb your tree. If the kids aren't causing damage, the cops are probably not going to do anything about it. Talk to their parents and ask the kids to stay off your lawn. If the misbehavior continues, ask the police to speak with the parents.

Yes, it is trespassing, and the kids' parents can be liable for any damage they cause. You should take any steps necessary to keep them off your property, especially if they are climbing trees, because you could be liable for any damage that comes to them on your property.

How old are the kids? If theyre young and just passing through what are they hurting really. Just ask them to stop before you go as far as calling the cops. They probably don't know it bothers you. The way your talking it sounds they go on your property to damage stuff on purpose, then i would call the cops.

yes that is trespassing but you need to tell the kids first not to come on your yard. do it nicely though or you may find your property damaged. also get that fence up as quick as you can because if one of those kids gets hurt on your property your libel.

Call the cops - you do not have to confront a pack of kids alone to first give them a warning. The cops will give them a warning for you.

Yes, that is trespassing, and yes the cops will do something about it if they can catch the kids doing it. (Keep in mind, the kids will scatter as soon as they see the lights, etc.) I suggest you just talk to the kids parents about the problem.

Come on ... they are kids between 6-12... maybe talk to their parents but come on.. they are doing no real harm to your lawn... weren't you ever a kid and just wanted to play? If this bothers you so much, talk to their parents BUT calling the cops and having a 6 year old charged with trespassing? PLEASE... I don't have anymore kids at home but I am sure glad you don't live on my street.
