Our situation is this, my fiance and I have lived in our new rental property for almost 2 months, and we are planning to move out because we have both been having allergy problems due to the mold that is growing outside of the house, we are unsure if there is mold inside the house itself, but we have to keep the windows closed and the air on because we cannot breathe when we our outside, especially when it rains, and we our wondering if we can break our lease, becasue the landlord is planning on taking us to court due the contract agreement we had originally signed. We are also having problems with the water system, and have had pest problems from before we actually moved into the rental property. These are all problems that were supposed to have been fixed BEFORE we moved into the rental property. Can You Help Us.............

If you have made the landlord aware of the problems & he hasn't done anything about it, then yes you can get out of your lease.

Have you thought of cleaning the mold with a spray bottle filled with water and a little bleach? You appear to have a lot of complaints. What is wrong with the water and the pests? You didn't specify. Also what part of the country do you live in. You will never get 100% and you may need to just do what you can and hang on till the end of the lease.

Do you have his guarantee in writing, that is that he was going to take care of the issues you stated? If you do not than such an agreement does not exist.

If the pest problem inside the property is of a heath concern, IE. and all out infestation contact you local heath board and tenants rights board. they will lean on the landlord to resolve the issue, if he does not then you will have grounds for an early termination.

As for mold outside the actual unit itself you are out of luck. Although the property is the landlords concern keeping it free from allergens is not.

If there is mold outside, I don't see why you can't live there. Where else could you live where outside conditions won't affect you?
Now the water and pest problems, if extreme, could validate you breaking the lease and getting your deposit back. Might have to go to small claims though.

Yep, if he promised to fix the problems before you moved in then you can break the lease based on the fact that he obviously didn't fix the problems. He can take you to court all he wants. He will lose

I doubt it. Mold outside is hardly under you landlords control.

I would take pictures of the mold and have doctor papers avaliable for when they take you to the court.

Spray the mold with watered down bleach, it will kill it. Then decide what you want to do.
