Last night, my wife and I were minding our own business, when about 6:00, some kids knocked on our door. They were dressed rather absurdly, and they asked me to give them candy. I had no idea who these children were, so I sent them away.

Over the course of the next two hours, there must have been twenty children who did the same thing. They ranged in age from infants to early teens, and some of these beggars even brought their PARENTS with them! I was appalled! I have never experienced such ridiculousness! At one point, I was so angered with their persistent and shameless groveling, I sprayed one child in the face with pepper spray, and as he lay on the ground wallowing and crying, I shouted, "TELL ALL YOUR DUMB LITTLE FRIENDS!!!"

Today, his parents knocked on my door, and have told me they will sue me for assault on a minor. I told them I will countersue for harrassment. Do I have a case?

you should've sprayed the parents' eyes too... might make it more difficult to identify you.

Your problem is that a member of the public ought reasonably be able to approach your property and "ring your bell" without risk of personal injury. Obviously you don't have hounds to release, otherwise you would not have needed pepper spray. Pity you couldn't stop them at the boudary fence.

Your counter claim for loss of amenity and solace for their tortious actions is a viable set off.

But I think you may stand a chance of defending their claim if you can prove that all those pesky little brats were in it together... thus warning one... is a warning to them all.

Did you mention that you posted a sign... "WARNING: bell ringers and candy grabbers will be pepper sprayed and risk serious skin and eye irritations"? (Better go and make one now.. I think you are going to need it ~ this is civil law.... everybody does it you know, jees.)

You would have to prove that this was a united front of harassment.. for example, were they all a members of the same gang... How you prove this is entirely a matter of investigation and presentation of evidence. You say that they were all dressed absurdly.... this evidence certainly works in your favour for example.

You will need a grumpy ol' bastard for a barrister, too.

Tell them that they have no case because you are going to countersue them for trespassing. You should tell those parents that they were lucky that you did not take out a shot gun and started shooting on sight of your properites.

I think all the parents throughout the neighborhood are liable. They should've known their kids were dressing up and going to random people's houses.
