That is okay wait for one year and then file for divorce in you county's ditrict attorney office, but listen when you are doing file as abandonment and that you can not find your spouse. After that they will send you a series of letter asking you to sign and if in 3 months your husband does not show your divorce will do threw. You can also go to you nearest health and social service department and they can also help you.

I'm in the same situation, however from talking to 3 different attorney's all of which confussed teh hel? out of me. The samething kept coming up you need to file at the court house, then put an add in the paper, if no response then it is can be done will not be contested. Any way my spouses last known address was in ca/ar so I do have a big problem if I want him to pay half of the divorce. The law is pretty clear on some issuses since we have no children, property to settle. It's cut, dry that way. Go online in your state there are plenty of divorce attorney's that will email you back with what to do.

My dad went through a similair situation. His ex took off and no one knew where she was. So when Dad wanted to get remarried, this is what he did: Put an ad in the newspaper, in the city where she was last known to live. The ad said that he was looking to get in touch with her for divorce proceedings. Apparently this will suffice a judge to grant a divorce, if the person does not answer the ad within 30 days. Hope this helps!

Start by making a missing persons report w/ the police. Then try placing an AD in your local newspaper. You may want to get some advise from an attorney, before spending $$ to hire a private investigator to try locating your spouse. Good Luck !!!

Getting divorce is simple in your situation. You have an easy uncontested divorce at hand. Why bother to search for someone you don't know where he is? Do you have the address you used to live together with him? If you have it, good. Simple thing, go to your nearest county divorce court, file for divorce and list your former address as the mean to contant him. The gov, will send divorce papers to that address, and if he change his address the postal order would forward to his new address. If he cant be located. the gov would search him on their data base(public record) and would mail out divorce papers to him. If he get those divorce papers, he had certain listed day (60-90days)that he had to sign and mail them back to the court. Filure to do so. one signature would be enough for you to get a divorce degree. Even if they wouldn't locate him, still after 60-90 days, you will get a divorce degree. So go ahead and file for divorce.

You have to make an effort to find him, by placing ads and such in the newspaper and by proving to the courts that you tried to locate him. It is hard but you can do it. It isn't that expensive. You can do it all on your own. Or hire a lawyer to do if for you. It is cheaper of course if you do it yourself, but it is more convenient and less hassle to have the lawyer do it for you
