My husband and I are currently going through a divorce. He was self-employed, so he was supposed to take taxes out of his own check. Unfortunately, he didn't do it, and now owes the government over $3000. He told me that since we were married during that time, I am responsible for it too, and if I don't help him pay it, the government will go after me as well. I don't know if he is just trying to threaten me or if he actually knows that. I am talking to a lawyer this afternoon, but would like an idea of what he will say.

I asked this question in another category, so sorry for the repeat if you caught it. I just didn't know which would be best.

nope he can't do that & don't worry there's a law lol
just remember to mention this (threating part) to the lawyer

ooh - unfortunately - the IRS will go after whoever seems most willing to pay and since you were married at least part of the year, you will get tagged for it. This might be an issue for civil court if you are forced to pay his taxes.

ooh - regrettably - the IRS will pass after whoever seems optimal prepared to pay and because you have been married a minimum of component of the 300 and sixty 5 days, you gets tagged for it. this would be an subject for civil court docket once you're compelled to pay his taxes.

How are you filing? That will have the most impact on who pays what. He is unlikely to go after you in court for his taxes if you file separately.

unfortunately he is correct the government will come after both of you since you were married at the time-however he can contact them and work out an arrangement to make regular payments until it is paid off-this will stop them from coming after either of you-as long as he makes the payments

Yep, I do think you will be forced to pay about half of it, but sometimes, the courts will tell his forgetfull broke *** it was his fault, and for him to pay it. Finantial burdan is all he can hold against you at this point and he needs to just let you go on your way and him on his own path.

I am not sure but I would think that you would be responsible for half of the taxes because it is still a debt that you owe....

Well, I'm in a similar situation. When we got separated, I filed my taxes as head of household, with kids. He didn't pay his, so I can demonstrate that I was responsible. In any case, please let us know what your attorney said.

He is blowing smoke your way. If he is your ex then that is what he is, your "ex". Any financial problems of his making are his to deal with. You were smart enough to get rid of him, keep it that way. No play, no pay.
