I have an employee who apparently didn't pay his taxes in 2004 (I filed the appropriate paperwork on my end) - the IRS has just sent me a bill for his taxes - can I be held responsible?

Did you get a bill or a garnishment?

Can you be held responsible for his taxes? No.

Can you be told to garnish the employee's wages and forward that money to the IRS? Yes.

You can't be held liable for an employee's debts, tax or otherwise. If the creditor has an enforceable claim--assessed taxes or a judgment, the employee's wages can be levied upon but you would get a levy or garnishment, not the employee's bill.

IRS could also determine that you misclassified the employee as an independent contractor and assess employment tax against you but a bill for that wouldn't just come out of the blue.

Marilyn,
Do not believe so.
u are responsible to pay/forward the holding taxes.
they are responsible for filing a tax return and paying their section of taxes that part u have no responsibility for.
have ur CPA assess what is going on.
call IRS to see what u don't.
