I ordered a "NO OBLIGATION" trial of a product which I received. After that I received another product from them. Apparently it must have been one of those "we'll keep sending you stuff until you cancel" things. I did not read that, I do not want the product they sent and I never ordered it. The company keeps sending me bills which I have throw away (I think the first one went strait into the trash because I thought it was junk mail). It's only $10 or $12. In my opinion, NO OBLIGATION means exactly that, I don't have an obligation to tell them to NOT send me something and I don't have an obligation to pay for a product I never requested (implied or otherwise). When I called, I was put through a long menu that I finally gave up on. Will the company eventually just give up or what? I can't see them wasting their time and money for $10, but I don't know the law regarding this.

Sahara, what lesson did I learn? Don't trust anyone because they try to manipulate you? It is stupid people like you that keep these conartists in business. You are such a stupid sucker!

The Federal Trade Commission has a regulation that says when a merchant sends unsolicited merchandise through the mail, it is making a gift and it may not enforce any rights to paymemt in respect of the gift. What the merchant is doing is a violation of §5 of the FTC Act, and the FTC would happily open a file. Just go to the consumer protection part of www.ftc.gov and fill out the complaint.

If you ignore this, they will likely send the file to a collection bureau and ding your credit rating.

What is your issue? Now you are being lazy and stubborn.

Call them and return the products. It's really that simple.

Next time read before buying or ask the questions.

You have no excuse and no leg to stand on here.

Have you tried looking on the internet to see if you can send an email? Keep trying.

I ordered a dvd in a club. I kept the dvd and paid. I called immediately to cancel. I had to wait and probably do what you are saying here. It was a year ago by now. But I did it. It wasn't that big a deal. Just do it. The longer you wait, the worse it will be. Take this as a lesson learned. Don't do it again.

I highly doubt that the company will give up on this. There aren't too many companies in the world that would just voluntarily forfeit money. It's my understanding that no obligation simply means that you have no contractual obligation. It does not mean that they will not charge you for products that they continue to send you. When you ordered that product, you essentially agreed to receive their product (at a price) until you tell them that you no longer want to product though you have NO OBLIGATION to continue to receive it. I'm sure that the menu system is intended to frustrate people so that they will hang up so they can't cancel their service, it's a common tactic among shady practices.

Did you maybe inadvertently sign up with a club to purchase a certain amount of products within a certain time and if you did, did you fulfill your membership obligation? Did you keep a copy of the order form for the original purchase? Sometimes they sneak microscopic fine print language in there that you might not be aware of in order to trick you. If so, I would send the company a cease and desist letter, by certified mail, return receipt requested (so you'll have proof), letting them know that you are cancelling your membership and any shipments you receive after the date they receive that letter will be retained by you and will not be returned. If it keeps happening after that, just enjoy the crap they're sending you for free...

It took me over 2 years to solve this same situation with Cooking Club of America. I never ordered anything and they started sending me books that were not asked for. Worse part was, they expected me to pay return shipping of $3.16 per book. I had gotten 2 books after my one year membership ended. Could not find a phone number so sent a letter to the company and told them to send me a shipping voucher if they wanted the books (by now I had 3 books) back. After many "legal notices", they finally said they made a mistake and I got to keep the books.

No one can tell you definitatively what or how to solve this matter as we can't read the agreement or text of the offer you agreed to.

THAT is the only issue.
