NO, not in India. The court marriage or marriage under the Special Marriage Act, 1954 clearly provides that neither party has a spouse living which is the very first condition for any such marriage. Either this Muslim man gives divorce to his first wife & then marries according to this Act or he marries this lady according to the Shariat Law applicable to Muslims. In that case this lady has to be a Muslim or converted to Muslim religion for a legal Muslim Marriage. In case this Muslim tries to marry according to the Special Marriage Act, 1955 & is found to be married, the marriage officer will refuse to marry him. In case this fact is not disclosed to the marriage officer & he gets married according to the Special Marriage Act,1955,then this man can face charges of bigamy against him under section 494 Indian Penal Code which his first wife can make & get him punished for this. This is the legal position which has been held by the Supreme Court of India in many such issues regarding second marriage by a Muslim according to another form of marriage other then the Shariat Muslim Law which allows four marriages on certain conditions to any Muslim man. In case any non Muslim who converts to Muslim religion for second marriage during his first marriage still subsist, marries second time according to Muslim law will still face charges of bigamy because conversion to Muslim religion was just for this purpose & his liability towards the first wife still exist for which he should have first given her divorce according to the matrimonial law according to which he married her & only then remarried the other lady. This legal position should not be ignored by any one including Muslims otherwise they will be in trouble.

The wording of your question makes it unclear, but if you're asking if a Muslim man can marry a second wife, even though he's still married to his first wife, then the answer is a definite No! Bigamy in the UK is illegal and the person's religion is immaterial!
