he signed the paper the day before he died high on morphine. since his death she cleaned out his bank account w/ checks he had signed so she can pay his bills that she never paid. she also took the cash he gave her to pay for the services. he assured me it was paid for. even tho he signed over life rights is there anyway we can get her out of there? if laws are different in each state just FYI i am in NY thanks for you help

no POA just life rights to his home although my brother and i now own it she just gets to live there rent free until she decides to leave or dies
she is everything evil always was and now her true colors shine through money hungry. my dad also left my brother and i evelopes w/ money in them he never got the chance to say where they were but i am sure she found them..she tore the house apart. he didn't believe in banks..but he was very ill and there was no way they could have been hidden he could barely move. i still can't believe she is doing all of this to us. we are a poor family she even cashed in his change lol...GREEDY..we just want our house and to be able to pay to get his ashes out of the funeral home...

You need an estate attorney to straighten out the mess. She cannot taken the money and run from his estate without paying his bills.

These cases are some what difficult, and unless your father was really rich, the only people who will benefit are the lawyers.

So, what to do. Get a lawyer. Try and get assets, accounts etc blocked. The lawyer sits down with her, all smiles and negotiates return of some of the money. She wins, you win, the lawyers win.

If you try to get everything back, then chances are she and you will have nothing and the lawyer will have a nice new shiny BMW.

I need to know you kids ages? Also, I need to know if you have proof of this woman's' improprieties to this marriage with your father. Did he ever question her promiscuity?

Surely her actions thereafter show her greed for money exists...i just re-read your question and see that she was NOT his wife. That under direst he (not in right state of mind) gave her power of attorney? Is that what you meant..POA Power of Attorney? YOU CAN FIGHT THAT, YOU NEED AN ATTORNEY...

if he changed his will while on morphine, you may be able to have the change voided. people have to be mentally capable of making such a decision in order for it to be enforceable.
