You can go straight to an attorney and try to get an emergency ex-pa rte order to take your children first thing in the morning, but you have to have the money up front and it is very expensive. If you think your child has been molested take a look at the warning signs on line and make sure you write it all down for the attorney to get into the order. I hope this works out for you!!

Ok first of all, an IEP stands for Individual Education Plan, I know, my 9 year old has had one since he was 4, now if he has custody, do you have any say? Cause you should have access to these IEP team meetings, and they only do these with very well prepared testing, so they may in fact need them, but even as I have sued and ultimately won against my school board for violating his IEP, I have never heard of one issued for emotional problems UNLESS it interferes with their learning, and the testing will/HAS to be in the childs "CUME" folder, the school has it and you have a right to see it unless there's some order in the custody papers. Molestation would HAVE to be reported to social services, I don't know what state you're in but here in Florida, if a teacher suspects this they are obligated to call the child abuse hotline which in turn reports to Department of Children & Families...and if the case has been closed, the records have assecibility, if your concern is for their welfare and you think he's causing this due to neglect or some other form of abuse, contact social services yourself and they will investigate his house and they do in fact interview children, they'll ask them how they're treated etc., they can also tell the worker their feelings about not wanting to live there and she/he could possibly find merit in the concern and they will file for a court intervention. Good Luck, but if you don't have restrictions on their welfare in regards to school, I would schedule an appointment with the teacher, counselor, staff coordinater, all these people HAVE to be present at any and all IEP meetings including the person that's providing the services that the IEP calls for, I know, I go to one every year, juat went to one on the 30th. Good Luck! Oh one last thing, again, if you have no resrtictions in regards to the school, you can request to be notified any time they have an IEP team meeting!

its not exactly rock hard evidence, you will need to connect this to your ex and make sure he is responsible for all this and not just some coincidence (even if it doesnt seem like one). id suggest take them to a hyponsis and have them uncover their memories have them recorded on tape and if things pop up that they have been abused then take that to court otherwise you can fight it but he has also a good chance (depending on lawyer) of winning

If you sincerely believe your children have been abused, you have an obligation - let me say that again - an OBLIGATION - to contact child services where you live......
Your first thought must be about their welfare. Not about custody next year or whether words truly exist, but about whether they are being taken care of or not TODAY.
Get your priorities straight

if the kids are asking for this there is a good reason... our children need to be heard I wish the system would give our children the credit they deserve, but you have to be thier voice and thier courage so yes you need to this for your children if you dont you may regret it in the future when your kids get older they may ask you why didnt you fight for us., there is nothing in the world more important to fight for than our children, they deserve to have every opportunity in life and dont deserve to have to carry so much sadness,
I wish you and your children the best

Call protective services and report this! Then you can worry about getting the custody ruling changed.
