im in rhode island and my landlord took away our parking space because she missed an appointment she had to be at because my car was broke down in her driveway that day. can she legally do that and if she can what are the rules on that? if she cant, then what can i do about it.

If you have a lease, and the lease includes a parking space, then, no, she can't do it. If you do not have a lease or the parking space is not included as part of your lease, then yes she can.

If you have a lease and the lease includes a parking space, and you are determined to fight with her, calculate what it costs to rent a space elsewhere and take her to small claims court for your damages. She'll, no doubt, be ordered to give you back your parking space.

In either event, however, her actions are capricious and punitive. How does taking away your parking space relate to your car breaking down in her driveway and blocking her in?

My advice is to move as soon as you can manage it. If this is an example of the sort of person she is, you're sure to have trouble ahead. People who wield power simply because they can are to be absolutely avoided. Be sure to do a walk through with her when you move out or expect trouble over your security deposit.

If she permanently took away your parking space then you should receive a decrease in rent to compensate for the loss. It would be the same situation if heat was included in you r rent and then suddenly the landlord said you must now pay for heat. This is a loss of service and must be compensated by a decrease in rent.

It depends on the contract. If it states that you get a specific parking spot, she has to provide that for you or she's in breach of contract. However, if there is no specific provision in the contract for a parking spot on the property, as the owner of the property she has the right to refuse to let vehicles be parked on the property. And, she would be perfectly within her rights to have your vehicle towed from her property.

If Parking is not stated as part of renting the apt in your lease or rental agreement, Yes she can.

No, your landlord is not authorized to dole out punishments of that type.

I would read the contract if I were you. You will probably find that she can't.
She is being petty.
