we are already separated, as it seems he will always be addicted to something or another. we have two little boys which i have always stayed home with full time. no job, family, or money of my own to fall back on, as any money he makes between now and january 2nd(the day he has to turn himself in)will go to pay his fine, for a reduced sentence. he'll probably do less than a year. he makes very good money running his own flooring business(no proof of income). and he is still paying our living expenses, as well as his own. i am frightened for myself and my kids, as i cannot even pay the rent on any job i'm qualified for, much less other bills and living expenses. he asked for a divorce before he was sentenced, but i wanted to work on our marriage. he was obviously not interested, as we interfere with his freedom and "fun time".now my family's future must come first. surely this has happened to other women. smartest course of action for me and my kids?HELP!!!

besides the child support issue, which i'm assuming he will have to back-pay when he gets out, i am morally, ethically, and legally (in MS) entitled to alimony. i am definitely not money-hungry, but after all the crap of the past four years, it's unfair to think that he will not have to pay alimony because by the time he gets out of prison, i will ,of course be working, although certainly not making the kind of money he did. talked to him after making the original post, and now he says he cannot afford a divorce, as he has to pay his fine. i was a good wife (especially considering what i had to work with!) and feel that he should have to pay me alimony when he gets out, even though i will be working. anyone know of a case like this, and the outcome?

what is he going to prison for? Obviously he is not really helping you just putting a damper on things. Get a divorce. Since he works for cash it will be hard for child support, but who is supporting you when he is in jail? he is not happy so get out before it is too late. Believe me I have been through this one! If he owns his own flooring business they should be able to track it some how. Is there anyway you can find some kind of paperwork to show a lawyer for yourself, showing he does have income? He has to have at least written estimates someone. Good luck to you!

I don't see that it is going to make a difference regarding your financial situation one way or another. He isn't going to be making money while he is in prison, is he? And, he will be liable for child support once he comes out, so the faster you get the ball rolling, the better, I would think.

Sorry to say this dear, but you probably won't actually get divorced before Jan 2. I started in Jan and am still barely started. And it is expensive. (I've already gone through $3,500) But, it's better to get it done as soon as you can (at least you won't have a problem getting him served!)

Do your kids really need a father that they know doesn't want them? My advice would be for you to start working. Get your CNA certification. While the pay's not bad, it can get better if you go on to become a nurse.
