Yes. The lease is a binding contract. However, unless he has a criminal record or is a sex offender, I dont know why they would not add him to the lease.

Honestly, if she was the only one on the lease, it is the prerrogative of the Landlord if they will allow another person on the lease. Her getting married and moving her husband in is no different than if she wanted to move a good friend in...if it wasn't in the original contract then she can't do it. Now, I can't believe that the landlord would be so callous about the situation, but that is thier right.

They shouldn't, but they can because he is not on the lease. But all she had to do is take them the marriage license and request that they add him to the lease. They will probably ask her to fill out a new lease in both of their names. If she has had no issues with the complex then it should be no problem.

They can because your daughter in law is changing the terms under which she leased the property. This shouldn't be a problem though. Just have them draw up a new lease agreement including your son's name. They may need to provide copy of marriage certificate. If your in law has had any trouble where she is living, they may be using this as an excuse to not extend her contract.

Sounds like they just want her out. When I married my husband the apartment complex just had him add my name to the lease and life went on.
Has she asked to have him added to the lease? Maybe he only has to fill out an application and they will accept him

Yes they can. All they need to do is add him to the lease. He may have to pay a deposit or application fee depending the rules at that complex though.

Of course they can, that is part of what a lease is about, you can;t just let anyone live wit you without some sort of contract....what is the problem? just put him on the lease.

No tell them that she is married now and he has to be added to the lease they cannot legally throw them out cause they got married . good luck .

And for what it's worth, I believe it is illegal for a landlord to put someone out in the street with no where to go

If they are married they need to add him not just kick him out. They can take that to court I am sure but after the lawyers and court costs is it worth it? Just take the money and go somewhere knew.
