I bought the house 5 years ago and our local permit department records show that there is an open unresolved permit on file from the previous owners and that they were in violation. The sellers produced a document that said the permit was finaled but it was not. I have spent $20K getting it fixed. Can I go back to the seller for fraudulent non-disclosure?

Absolutely, if you live in Massachusetts. Check with a local real estate lawyer.

yes, you can. And they should have to pay for all of what you have paid for. But good luck in getting hold to the seller. That might prove to be a challenge.

yes you do but that is what title insurance is for and I am suprised that the lender didn't find that
