roof is leaking and i have toxic mold problem they will not fix roof because it was laid wrong should they have seen it during inspection prior to sale and handling the coverage of my home please help

The insurance company isn't liable for inspecting your home before they insure it. This is essentially a pre-existing condition and they are not going to pay for it.

Hopefully YOU hired a home inspector before agreeing to purchase the house. They should have seen the damage and reported it to you at that point.

Here is the crappy part. In most states the home inspector is not liable for things they missed. In most states the most you can get back from a home inspector is the amount they charged you for the inspection. So, the inspector misses a bad roof and mold, you sue the inspector and get your $350 back to fix an issue that will run you in the thousands or tens of thousands.

Don't be surprised if your homeowner's insurance company drops you because of the mold. They hate the word mold.

You do realize that insurance isn't there just to protect you from having to pay to fix things on your house, but is really there for liability issues and 'acts of god', right? Just because your roof needs replacement doesn't mean the insurance company will pay. Now if the roof gets blown off during a wind storm or tornado, then they will pay to replace it. See the difference?

First how do you know you have toxic mold? You can't tell by looking at it and the only way to tell is to send it to a lab and have it tested and I bet you didn't. There are thousands of types of mold. I also bet you did not have a home inspection. The insurance may cover you but you will need to call them.

If it is your home insurance, then they are not liable. Unfortunately, it is your job to inspect the house prior to buying it. However, you may try home warranty insurance. You usually have one for about a year from your purchase. It is purchased by the Seller for you for things like this.
