I liked the song but I think Timberland spoiled it slightly. It didn't really need his drum loops and "yeah yeahs".
In my opinion its too late for him to apologise!

I don't think it's ever too late to apologise. It can only make things better most of the time unless the other person is unforgiving or you have greatly wronged him. So go ahead and say sorry to your special someone.
