I have been living with someone for 15 years in the state of New Jersey. It is my condo...he gives me a little $ each month. My question is...if I die, will a judge say that since we have been together so long, the house will be his. I have a will and everything is going to my children. I hear there is no "common law" ruling in NJ as of yet. I did ask 2 lawyers and they said there would be no point in making a "living together contract." Can anyone advise me please??? I am terribly worried about this.

No, your family does. You're not married, he's not family...why would he get anything? Unless NJ still uses the "common law marriage." But, there's not. So, what do you have to worry about...the big question you should be asking is why you are worried in the first place?

there is no common law ruling because there is no common law in NJ
so he would not get the condo, he may give you a little $$ and you can construe that as rent , but as you know rent does not build equity
however
why do you have a will?
put in a trust instead
avoid probate and the taxes that go with it
as a trust keeps it in the family ( you name the parties in a trust )and you can keep the trust revocable or irrevocable depending on your wishing, on your passing the condo staying the trust, since it's still owned by the trust there is no probate, it's as you basically changed CEOs of your trust, there is no assessment in property taxes since there is no transfer of property,and until the trust dies out ( literally ) or is update to include or exclude members, it will always remain in the family

You already consult a lawyer so why are you so worried about this. If you have a will and everything is in order, then there's no cause for you to worry.

Why are you so worried about it? Are you very sick? Do you not trust him to have the condo if you pass? If you don't trust him why have you been with him for so long?

im pretty sure that he wont get your house but he might live in it if you give it to someone before you die he is not going to get it and if you sign a will that says what you are gave it to some one else going to give to him he probably not get it because you already

You sound pretty young, why on earth are you worring about it now? You sound suicidal to me. Get a counseler. Oh and if you die it depends on what your will says.

If you do not leave it to him and he is not on the deed he cannot have it.
