No physical contact involved. I would think that this would be protected by the First Amendment-Freedom of Speech. Just curious.

Depending upon the local laws and state statutes, yes. It could be disorderly conduct, creating a disturbance, breach of peace, or even assault (assault is threatening someone or thrying to hit them and missing; battery is hitting someone).

You're right to free speech has limits. Once you use speech to violate another's rights, you have crossed the line.

It is not free speech if it is done in public where others are subjected to the tirade. The ticket you would get is for obscenities and disorderly conduct. Additionally, free speech doesn't count if the words you use would incite a riot or could be used to cause an escalation of another problem. Again, it's disorderly conduct or obscene behavior or inciting a riot. If you yell "fire" in a theatre, it is not free speech, it is public endangerment. A couple of years ago, I read in a law bulletin about some teenagers who were swimming downstream away from the general public but they were using the f-word and other obscenities loudly enough that the people down the beach who had children could hear them. Those teenagers were charged with lewd and lacivious behavior, disorderly conduct, public indecency and several other charges. I don't remember the outcome but I don't think the free speech defense was upheld.

There was a drunk guy on my street just arrested for yelling and screaming. Disturbing the peace. Disorderly conduct.

Yah but they call it disturbing the peace when actually its disturbing the police... Or they call it disorderly conduct... But really they are taking away your right to freedom of speech...

You can get locked up for anything. Write a blog about how our President is a liar and homosexuality, however, and the assassins will be waiting at your bed.

yep my brother in law was arrested for yelling at me for asking if he needed help fixing his car and the neighbors heard him and called the cops and at the time I was 11 so they wrote on his charge child misconduct/child abuse I have never seen cops get somewhere so fast in all my life there was 6 cops e spent 2 days in correctional facility and two days in prison with 6800 dollar bond

my neighbor keeps calling the cops on my five year old saying that he is playing in his mailbox box but everyone that is playing with him outside says that he is not. my fiance said something to him about it and the man started calling him names and that makes him mad so he starts yelling at him. all he is doing is defend our child and the cops tell us that if we yell at him again that he is going to arrest us. since when is it a crime to defend our children that can not depend themselves.
