The national highway act of 1984 states that states are complied to raise the drinking age to 21 or the state will get 10% cut from their annual federal highway funds. To me, this is against the 10th and 21st amendment. Because of one group, MADD, who is trying to prohibit every single alcohol. I think we should repeal this law and create another amendment of maintaining the age of 18 or better yet make a consitutional amendment. Take for example that the legal limit for BAC is .08% while for under 21 is .01%. This is ridiculous. Please send you thoughts out.

sounds good to me i think the government is getting all up in our buisness about way tt omuch like smoking! you should say somethin about that to have u seen the law in wa. an ca.

It's not a violation of the 21st Amendment because the 21st allows for reasonable regulation of alcohol consumption.

It's not a violation of the 10th amendment -- because Congress is simply setting a policy for how it will distribute federal funds -- and distribution of federal funds is explicitly within Congressional authority under Article I Section 8 and Article IV -- so, the 10th doesn't get involved, because such distribution of federal funds is an explicit federal power.

Yes, it's shady -- in effect, it is extortion (or a bribe) to convince states to "voluntarily" set the drinking age -- because Congress cannot force states to do so.

But because it's only a condition on distribution of federal funs -- which Congress has sole discretion and authority to distribute -- Congress can give nothing if it chooses, and would be entirely within its Constitutional rights.

As for your propose changes -- the law can certainly be changed. But the current law is constitutionally allowed.

My thoughts are that you are under 21 years of age and want to buy alcohol. Only minors would agree with you views. Drinking should only be made available to responsible people. Most people that are under 21 are not responsible. In fact most people I know that are under 30 are irresponsible. I'm not saying that we should raise the legal drinking age, but I also see no need to lower it.

Hate to break it to you, but the federal gov't uses this all the time (the latest being seat belt laws, cigarette sales) What is the problem with the 21 yr drinking age? The facts are EXTREMELY clear, with the change in age, drunk driving fatalities plummeted. Teenagers can barely drive completely sober, never mind with booze to confuse them...If your underage, ANY amount of alcohol on your breath should (and is) illegal...
