I left my husband 4 years ago. He has now remarried and I've seen that he still beat's his current wife. I allow him to see the kids ( if i'm there). Because he was busy with business and travelling abroad, he didn't mined this arrangement- because he hardly had the time. Yesterday he served me papers that he wants full custody over my 5yr old and 7 yr old. I don't want them to be in an abusive enviroment.
I fought him for custody when we first got divorced and the judge still insisted on joint custody even after clear evidence of abuse( 20 emergency visits, 7 days in comma, i thought that this would be sufficient). Because of his high profile in politics in the states and his money, he seems to get away with and cover up his wrongdoing's.
I'd like to find a solution to tackcle this.

Girl those are your kids... next time u go to that courthouse... you show that judge, jury, and most definitely your ex husband that you are a strong *** woman who can hold your own... show him that he could not and will not get you down... fight for them kids girl...

Girl no the judge will not give him full custody of the children you take your evidence and mention that he beats his current wife tell them your kids told you they have seen him do it they wont question the kids, the kids are too young for questioning or getting them involved in court things, so you tell them that and that your afraid and concern about their well being away from you where you can't visit them, I really don't think there is nothing to worry about, and tell them you want those visitations supervised by either you or someone appointed by the courts.. this is a violent man 20 visits to ER and even put you in a comma, don't worry he won't get them...fight and stay strong it was good for of you to leave. Call your attorney, and just keep being mad, and keep fighting, there is not a judge that will allow your husband to have custody of your child no matter what his job is!!!!
Keep fighting, and get a really good attorney who has had to deal with issues yourself, I know people with money seem to get the upper hand, but if we all stand up and fight for the children someone will hear us!!!!!!
Just keep fighting, and if you feel like your attorney is not doing his job, then fire him, and get another one with more power and more contacts to deal with this legality issue.

oh boy... he basically wants the kids for selfish reasons... what was in that Judge's mind when you brought forth this evidence? ugh! joint custody? pfffttt...!!! perhaps you could get his new wife to testify as well??? good luck! don't let him take full custody... he has no reason... just keep fighting w/ a good lawyer... you can also make him pay for your lawyer... if he loses the case! oh I hope you can get this lady to divorce him as well... !!!

I have this same problem in Ca. Take everything that you have,every date, every peice of paper, every friend,every co-worker with you that has imformation. Ask you local womens shelter for help,they have legal services. Bring everything to court and ask the judge to stop him from taking the kids to NY. Good luck.

Consult the battered wife's assistance in your community. If you can't find them, call the police dept. They will know where to direct you. See if they have any ideas on how to eliminate the problem. The only other thing that you can do is have him followed, and get proof of his violent nature. They can't argue with pictures.

The question here is: do either of you live in NY? If not, he cannot legally take the children across a state line without your WRITTEN permission.
