The office of Attorney General has been vacant, since the resignation of Alberto Gonzalez on September 17th.

Peter Keisler, the Assistant Attorney Genera, is "Acting Attorney General" but the office of "Attorney General" is vacant.

The President has nominated a new Attorney General (retired Federal Judge Michael Mukasey ), but 'e will not take office until confirmed by the Senate (which seems entirely likely).

There is no present attorney general. You have an individual nominated by the president -- Judge Maukasey (and I am probably misspelling it) -- who is yet to be confirmed. For now, the Department of Justice is being run by whomever was the hightest ranking official left in the Department (given how many Deputies and Assistants have resigned so far this year).
