I was recently searched for illegal substances on my person by a gardener at my school. I did not give permision to him or the principal, who then proceeded to search my phone without permission.

Most everyone has a good point. We might be missing something here- why would anyone (including a gardener) want to search you for narcotics?

But the main thing is - anyone touching you without authority is in trouble. Call the police, make a report. And while you're doing all this, get your parents on board. I say this because if you get stoned frequently, they probably know. And parents might not support you in any litigation against the school if they are old-school. You also didn't say if you're 18 or not. If you are, I think you can prosecute on your own. But make sure you get your parents behind you. Local prosecutors may vary, but without your parents behind you, they may decline to make an issue of this event.

Like everyone else, I think it's an unusual school that allows gardeners to police its students.

Not sure why the principal "searched" your cell phone. What was he looking for? Did he find anything? You've got some weird situational and legal things happening ... good luck!

I would contact a lawyer. Each state may vary, and you don't want to take someone's advice over an internet room like this. This doesn't sound legal however and you may have a pretty good case. Especially if it's a gardener that searched you.

Well I don't know about the gardener bit, but them taking your phone is perfectly legal.

when you are a minor and at school, the school is your "guardian." You pretty much have no choice as long as they had probable cause to search you.

remember: it's one thing to get laced up at a party every once in a while, but it's not okay to be stoned all day long all the time.

report the gardner to the police for groping you and see how fast his sorry a** ends up in jail. They have no right to search you, especially a f***ing gardner.

No, you have privacy rights. They shouldnt have done that to you.

Leave your phone at home, you shouldnt need it at school anyway.
