“A motorized scooter may be operated on a bicycle path, trail or bikeway, but not on a sidewalk. On the roadway, it must be operated in the bicycle lane, if there is one. On roads without bicycle lanes, motorized scooters may operate where the speed limit is 25 mph or less, and shall be ridden as close to the right hand curb as possible, except to pass or turn left.”

“A motorized scooter is a two-wheeled device that has handlebars, a floorboard designed to be stood upon when riding, and is powered by a motor.
The California Vehicle Code does not require registration, license plates to be displayed or the scooter to be insured.
Even though insurance is not required, owners of these scooters should contact their insurance company to determine if coverage is available.
An operator of a motorized scooter must be at least 16 years old, possess a valid drivers license or instruction permit, and wear a helmet.”

*/End of Line.

Yes, I actually called the Orange Police Department a month ago to ask about that, because I sold one on e-bay, and I wanted to be sure that it was legal to ride before I listed it. I was told that it can be riden exactly like a bicycle, in the bike lane if there is one, or to the far right, and a helmet is required. A drivers license is NOT required. It doesn't have to be smogged, so the clean air emmissions act doesn't apply to gopeds.

Here is the current senate bill on gopeds:
The California "Motorized Scooter" Law

Senate Bill 441 (SB-441)

January 1, 2000, it will be legal to drive a Go-Ped® on the streets of California provided that the driver follows the legal requirements as by the state of California.

- Driver must be 16 years or older, a California drivers license and registration will not be required

- Driver MUST wear a helmet.

- Go-Ped® must be driven in the bike lane or on the right side of the street, and not driven on the sidewalks.

- The maximum speed limit for a motorized scooter is 15 mph.

- If a motorized scooter is driven at night, the necessary reflectors and lighting equipment will be a requirement. These items and safety equipment can be purchased at most bicycle shops.

Although, Go-Peds®were not designed for street use, Patmont Motor Werks advises everyone who wishes to use a Go-Ped® on the street to do so with extreme caution, and always use the recommended safety equipment and recommendations clearly stated in the manual.

We advise those drivers of Go-Peds® that in the event of an accident, there may not be coverage under vehicle or homeowners insurance policies. Therefore, should you choose to take advantage of this new freedom, this must be done with a great deal of responsibility on your part

that first-time offenders cited for riding the scooters on streets can be fined a maximum of $100, but there is a learning curve for officers in deciding how to deal with the vehicles.

In most towns and cities, it is illegal to ride any motorized vehicle on the sidewalk. Also, in most tows and cities, it is illegal to ride a bicycle, skateboard, razor, and scooters on the sidewalks. You have to check with your local police on that.

You can in New York city.
Call your local police department.
They're the ones that will be enforcing the law.
So they would know best.
