My brother just got arrested in NJ was arrested (first offence) for tagging (graffiti) a dumpster and he had three grams of pot with him, as well as a pipe...how much trouble will he be in? any ideas? he's freaking out....not that i feel bad for him, he screwed up big time!

The link posted by the first answerer is good. The six months jail and $1,000 fine are maximums. There is no guarantee he will go to jail. However, he will get slammed with fines and penalties. NJ has a long list of fees it charges with municipal court fines, the proceeds of which go to good causes within the state. That, of course, is little consolation when you add them all up. His DL or Learner's Permit may also be under threat.

What your brother must do is convince the judge he is truly sorry and that he has mended his ways. Would he be able to attend NA meetings? That will not do him any harm, both in terms of his court appearance and in general.

3 grams of pot constitutes possesion with intent to sell in most states, a felony, and having the pipe is possesion of drug paraphenalia, which is a felony as well. He could theorhetically be looking at a lot of time. In actuality though, they will probably knock it down to simple possesion, so he'll probably only get 1 or 2 years in prison plus a thousands of dollars in fines.

Gettin' caught with drugs is a pretty serious offense. But as long as he wasn't selling, I don't think it will be too bad if it's his first offense. (Maybe a year at the most). However, I COULD be wrong.
