Yes, only if you are not subject to the law governing the EEOC, exempt from the law, or legally privileged to avoid the law. This is the case with most regulations. Todd Crawford, Esq.

All the company has to do is find any reason that is not illegal (race, age, etc) and not hire the person for that reason. If the company is smart, there will not be any written reason for not hiring the person, and it would be next to impossible to prove discrimination without it.
