I thought it was illegal to ask somebody about their marital status in either a job application or an interview. I also thought it was illegal to ask if an applicant has children. Please answer.

It is not illegal to ask the questions, what is illegal is to take adverse action based on the answers.

i.e If you ask if the person is married or has children and do not hire the person based on their "yes" answer then you have taken adverse reaction and can be held liable under EEOC.

If you feel that you have been discriminated against based on your answers then file a claim with the EEOC.

It is illegal to ask both questions. Things can come up during an interview where you can volunteer this information but it can never be a deciding factor in hiring someone. Sounds like your interviewer isnt very experienced.

yep you can't ask either of those questions, they are not bona fide occupational questions.
