Is it illegal to charge smokers a re-entry fee.

In england smoking is banned in enclosed public placs. Some night clubs charge an entrance fee but do not have a smoking area. If you want to smoke you need to leave the premises.
Some of these club stamp your hand and give you a ticket timed. If you back within that time frame you pay a amount to re-enter the nite club but not the full door price.
Is this illegal??

i.e. you pay £5 to enter the night club, a few hours pass and you go for a smoke. You get your ticket and hand stamped. then on coming back in you have to pay a £1 re-entry fee.

Am not sure its right but then it may just be unfair.

I think it's unfair, but I doubt it's illegal. Generally, private businesses are entitled to set their own entrance policies and fees.

Not being from your country...I'm not sure if it's legal or illegal. It does sound unfair and a possible way to increase revenues for the clubs. (That might be illegal). We have the same laws here. However...we can go outside or on the patio and smoke. I've never been in a place that charges me to get back in. I'll let you know if that changes. They can only push us smokers so far until we fight back. As we speak...I'm considering a lawsuit against my great home state of Texas for the unfair tax of $1.00 a pack on cigarettes.

Pay the extra $1, then FIRE IT UP inside the club! What are they going to do take away your birthday? They won't let you go out to smoke so it seems that they want you to smoke in their club!!!

It's probably not illegal - but it sure smalls like a scam to boost their revenues. I bet if enough smokers complain, this policy gets the boot.

That doesnt seem right, I mean you already paid your fee for entrance just like everyone else, i dont think you should have to pay more after that.

i just wouldn't go to that club. cause i for one would be smoking more than every few hours

It is unfair as hell, i wouldn`t go back there.
It might be legal but i don`t like it.
