Depending on the state in which you live, it might be some kind of assault or disorderly conduct. Below is a link to a resource where you can select your state and then search through the legal code for yourself for information.

Select your state, then choose "primary materials." From there you will just have to search a bit.

honestly i don't know,i guess it would depend on what lead up to the incident as too how the police would handle it. because the other person didn't lay a hand on you.

In England it is technically assault, but it is unlikely that the Police would pursue it, especially if the person apologised (assuming intent). They would more likely let them off with a warning, which is not a criminal record.

If you are under 21 a creative prosecutor might say the person contributed to your delinquency by "giving" you the beer.

Unless you're going to try to make a citizen's arrest, you wouldn't do the charging, the police would.

You could complain to the police and try to get the guy charged for assault, but I think they'll just laugh at you.

It is Technically an assault.

It is also behaviour liable to cause a Breach of the Peace.

Spitting falls into the same category.

Yes, technically it is a type of assault. But, since there was no physical harm to anyone, it is unlikely to be prosecuted.
