There are laws that prohibit firing for certain reasons, such as race, gender, etc. Generally speaking, firing for any other reason is legal unless a contract says otherwise. I assume bar employees do not have contracts that say that they can only be fired for cause; if I am wrong, check the contract. There are some exceptions, so she should ask a lawyer if she really wants to know.

Unfortunately yes...b/c doing that isn't a legally protected class.
People need to remember that HUNDREDS of people lose their jobs b/c of their behavior during holiday parties every year.
Remember..you are STILL at work in the boss' eyes.

It would be legal although fairly strange. In the US, under "employment at will", they could fire you for having blue eyes if they didn't like blue eyes - obviously ridiculous, but legal.

yep - a bartender is probably an 'at will' employee. the employer will probably cite other reasons as well. plus the criteria mentioned is not subject to strict scrutiny, but rather mere rationalilty.

That certainly is pushing it as a reason to get fired.
If your friend pushes the issue, the employer would likely find another reason for the firing.
Tell your friend to talk to a lawyer.

Most jobs are "at will." In other words, you may be terminated for any reason and at any time.

Apparently yes. But that doesn't seem ethical.
