I am not on Medical Leave. My boss is still paying me as if I were working and has been for a month. I have been told that my job is there when I return to work. Now he is encouraging me to apply for disability. I could get better soon and be able to work again. Legally what should I do ensure that I keep my job?
Any advise would help

Your boss rocks.

Definitely apply for disability--you have a wonderful, compassionate boss who will likely have a position available when/if you are able to return to work in some capacity.

Be prepared for the long road--you will likely be turned down the first time you apply (my uncle had a stroke and was completely incapacitated. He still had to hire a lawyer.) But do not get discouraged.

In most positions, there is nothing you can do. Most people are employed at the pleasure of the employer. It sounds as if you have a good one, too, though.

The disability application sounds fair to me. Most businesses can not afford to carry someone indefinitely and it may also open up additional avenues of getting assistance for medical care. Talk with your state Labor Department. That is why you pay taxes to hire them.

Is your boss talking about Social Security or some other form of government support or is he talking about a company benefit called "short and/or long term disability insurance" which is provided by the employer as a benefit?

If he is talking about this insurance, then you need to take advantage if it.

If you are covered under FMLA, that would protect your job for 12 weeks. If you are off longer than that, unfair though it might seem, they don't have to hold your job for you.

he has been an excellent employer, most would have replaced you long ago.
consider his suggestions.
talk to your doctor, see if he thinks you will be able to return to work and how soon, then discuss this with your boss.
