I have a person living in my house. They pay me a monthly sum to do so. There is no lease agreement. Are they considered legally a boarder or a tenant. If they are a tenant or boarder, what rights do they have in respect to being removed from the premises.

Teant is ne who lives in a separae room or flat on payment of rent. If he pays rent regularly and does not cause any nuisance he cannot be evicted without following legal procedure.

A boarder is one who lives along with y ou as a family members,having his meals,breakfast with you. What he pays includes the cost of boarding and only a symbolic amount of rent for sharing the premises with y ou. You can ask him to leave if it is not convenient for you to make arrangement for his meals etc.That way he is at your mercy.

He a boarder and can be removed from home when ever the month that he has paid is up. Where a tenant has or had a lease. They are harder to remove but there alway ways around ever law. eg. 1 day late on rent but only in america. In Australia you have to take the tenant to the rental bond board and they have to be at least 3 weeks behind in rent. Then you can give them 2 weeks notice. But if there no reason to kick tennant out you have to give them 60 days notice to vacate the premises

A tenant rents a sperate living modual. A boarder rents with shared amenities. Where I live a month to month agreement requires notice of 1 full term (month) unless there is a threat of violence or non payment of rent then the eviction notice can be 24hr. Remove all personal belongings as in some jurisdictions that is just cause for break and enter.

They are boarding with you. A tenant has to sign legal papers. You simply need to give your boarder notice. If he pays you monthly, then you need to give him a month's notice to find somewhere else to live.

A tenant is one who has the legal contract with the landlord for leasing the property. A border can be anyone who the tenent allows to stay they, either temporarily, or permanently.

Tenants or boarders are basically the same but if you do not have a contract, you can eject them anytime because they do not have records to show their rights.
