In these cases a lot of jurisidictions have capped amounts for injuries. I'm not familiar with the laws in Illonois however this could be accurate.

What I will reccommend is that you get a lawyer. Regardless of what the action is and whether the amounts are capped (they are capped not to give a mandatory payout but rather to ensure that the defendants are not unfairly disadvantaged) it is ridiculous to go into court without a lawyer. You're opposition, I'm assuming your employer, will most definitely have legal representation, and it would be extremely hard to win a case without a thorough understanding of the law.

Firstly you need to find out whether you have a case. It is only negligence if your employer did something wrong. If they provided ergonomic equipment, gave you training in how to avoid getting carpal tunnel and did absolutely everything required by law to prevent this, and you managed to get it, you may not have a case as they will argue that you did something wrong.

Secondly, your lawyer will be able to advise you of what sort of compensation you could expect to receive if you have a case.

Thirdly, they will be able to handle the case for you.

I would suggest you work with the workers comp adjuster. They can walk you through the process. If at any time, you decide you don't want to work with them any more you can hire a lawyer.

Keep in mind - a lawyer will take 25-33% of your settlement Plus his fees.

In many cases folks will end up with more money without a lawyer than with. Remember - if you hire the lawyer it's your job to pay him - not the workers comp company (they did not hire him - you did)
