I am in the process of buying a Condo. If everything goes well, I'm going to have my condo by the end of November. The thing is I don't want to pay my rent and my mortgage on december. So I am trying to figure out if there is a way, that I don't pay my last month of rent and just tell the landlord that keep the deposit ( that is one month of rent). Do you think this would work?? Or he can say no way?

I want to stay in my apartment for the month of december so I can do an organize and gradually move.

What do you think about this sounds logic? Or I have no chance? By the way the apartment is in good condition I don't think he can complain about anything so anyway he is suppose to give me my deposit back, so at the end it's the same.

I'm sure that your lease has a clause specifically requiring you to pay your last month's rent rather than applying the deposit. However, if you're willing to vacate early, you might be able to negotiate something with the landlord, since that will give him more time to get a new tenant. Invite him in to see the good shape you've left the place in. Then talk to him frankly about your situation. Offer to leave by the 15th if he'll allow you to apply your deposit. Chances are, he'll go for it. Good luck!

Most leases state that you can not use your deposit as the last months rent. If you want to stay in the apartment to organize you'll have to pay rent. The landlord has 30 days to return your deposit minus any damages. If you say it is in good condition take lots of pictures. It would be rare, but your landlord may let you stay and use the deposit as rent if you can get him there to inspect.

Deposits are not rent. They are deposits for damage to the rental unit. I always go through the apartment with the tenant after they move out... not before. You can ask the Landlord to use it as rent, but don't be too depressed if they say no. Sounds like you needed to plan a bit better for your move. Why are you trying to dump your money problem on your Landlord? Hey mind if I borrow your car for a cross country trip? Could I get a few hundred for gas too? I really don't want to spend any of my money....you know. I'm sure you understand...right?

No, you cannot let the deposit ride for the last month's rent. The deposit is to protect the landlord against any damage you may cause, NOT for the last month's rent. You have to pay the rent as agreed or you will face eviction and suit for the unpaid rent.

Doubtful. You have a lease and it runs through Dec. 31st and you pay til then. The security deposit is to cover damages, not rent. Consult your lease and see if any special stips occur that you could utilize.

Most landlords will not go for that.

The security deposit is not to be used for rent.
