My husband is in the military. If someone breaks into my house and I use a gun to defend myself or my children, can I be charged with a crime?

I don't own the gun. My husband is in the Military, he has the gun.

Yes, because you are probably not allowed to legally possess the gun.

It depends on whether or not it is reasonable for you to subjectively believe that your life and the life of your children are in danger. Even if you have a felony conviction, you can still act with deadly force to defend your life and anyone else's life as long as they are in deadly danger.

Since it is someone breaking into your house, your subjective intent to use a gun will be considered very reasonable since there are children as well. Whether or not you had a felony conviction should have no consideration legally.

Felons are not allowed to have guns. So, yes, you could be charged with a crime for using a gun, even to protect yourself or others.
