Don't think of could ofs... be thankful you are alive. Cherish the moments you have because they did NOT hit you. Don't dwell in vindictive tendencies, they will only serve to create tension in you, which can manifest itself physically.

Take care.

There is a system of vehicle insurance to compensate people injured in accidents. It works quite well.

Then there are people who sue. In general, when they win the law suits, the amount of money awarded is peanuts compared to what they would have got by going through the insurance system, and the lawyer getrs maybe 1/3 of the award. Most fail to win, and still have to pay the lawyer.

If the truck had hit you, there would have been an obligation to have a police report to determine if the accident was your fault, or that of the truck driver.

If it was your fault, then any harm done to you should be paid by your insurance ... if you have no insurance then your tough luck for being careless about your own protection.

If the police ruled that the fault was that of the truck driver, then the insurance on the truck driver would need to pay for your medical expenses, the damage to your bike, and any incidental expenses like loss of pay when you can't work, cost of alternative transportation until your bike repaired or replaced.

Too many varibles to say. Did the truck have a reverse alarm operating on it? Why were you in back of it? Anyone can sue but getting the suit granted requires proof of negligence.

Almost backed up into you? You gotta be kidding me. You can only successfully sue someone for actually hurting you or causing some kind of damage.

Yes, you could have sued them for obstruction of property and gotten the value it would take to repair the damage, as proposed by an estimate.
