I gave them my debit card number to use maybe two times for one pizza each time....they said they would pay me back.....Then, a few months later, I get my statemtn and see that I overdrew......I looked at the details and saw that the person had used my card to buy a lot of stuff.....including pizza and phone cards......adding up to about $400......I can prove that I wasn't the one purchasing because the transactions were all made in Georgia, and I live in Chicago Illinois....This was one year ago...and the person kept saying that they were gonna pay me back but still haven't done so to this day...What can I do to get my money back?

When I talked to my banker about it a few months back he said that I could file a report against that person....they said that since I was 17 at the time and the other person 21 that I would have a good chance..but im not sure... I kept all the statemtents and highlighted the transactions which I didn't make....on the statement it even says that the transactions were made in Gerogia...and on the same days I had myself made purchases using my card in illinois.....I have a new debit card now, but I really need the money because I owe someone some money.

And yes, I have learned my lesson... Back then I used to think that everyone in the world was nice and everything...now I know for a fact that a lot of the time, people are liars who say one thing and do another.......

If I were to sue them, couldnt I include the fees for the attorneys and stuff..thats what I read in my law book.

If you gave them your pin number the bank won't help you. You could try small claims court but it probably isn't worth the time or money. . . say good bye to your money . . . and that bad friend!

If you give someone access to your card and pin number, you are responsible for whatever they buy. The bank wont get involved and you cant take criminal action against them. You can try to get something through small claims court but by the time you pay the filing fee and the fee to have them served you've already spent more than you will get. Also even if you get a judgement against them, you will have to figure out how to collect it. The court doesnt do the collection. You've learned an expensive lesson.

You can sue them in small claims court. You have to get all the detail of the transactions. Also, you might want to take someone who heard this person tell you that they were going to pay you back. Good luck.

Have you learned anything from this experience?

If you have it was money well spent. If you were to sue in small claims court I believe you would have to do it in Georgia. Some others may have some other advice to you; but my suggestion is to never lend money to someone who can't afford a pizza, and never lend money to friends, it is a good way to end a friendship.

Change your debit card today and you may have to take the person to small claims court. I don't know how hard that would be to prove that it wasn't you who bought those things.

Take them to the small claims court of jurisdiction...and talk to an attorney if you can for cheap...380 bucks isn't worth going after if your lawyer costs 500 bucks...

Absolutely NOTHING. You authorized this person to use your card, and they dishonored your verbal agreement. In the absence of any written documentation that this is a loan, you're out of luck. It's their word against yours.

What on earth WERE you thinking, giving a debit card to someone to use ?????
