Hi i'm a single mom of a 3 year old son. HIs father has never been around and now he and his girlfriend are sending me text messages telling me that they're going to take him away... he is not on the birth certificate he abandoned us when i was pregnant I am scared and dont know if he has any rights as a father or if he could take him away please some one HELP ME!

He does have some rights. He will have to prove paternity and will have to pay child support. He also has a right to visitation. He can not take your child away from you unless you're an unfit mother, which I doubt.

Protect yourself and your son. You don't want to deny your son his father. But, document everything concerning his father. Document visitation, texts, calls, etc. If he sends you money, clothing, gifts, etc. keep records of everything. Because if you ever go to court you want to prove that you've done everything you can to facilitate a relationship between your son & his father. You want to show that it was his father that chose not to see his son. Be sure you have dates for everything as well. Right now, there is no court order that says you have to let his father take him for over night visits. So you can supervise all the visits if you don't trust him taking your son. He has no rights unless he petitions the court for a change of custudy. The mother holds full physical custudy when a child is born to unmarried couple. BTW, depending on what state your in, filing a change of custudy petition costs at least $100.00 and is a pain in the hiney.

Don't worry he has know chance of getting your son ,,,try and save the Text messages though ,,for future ,,,court case in your favour,,,Good Luck,,,
