Would the court consider her a custodial parent ? By virtue of the marriage ?

Nope, not unless she adopts them. She would have to get your daughters consent to adopt, and some how I doubt that is going to happen. Now, she may be able to do things like pick them up from school or something on the days he has them, since she is his wife, but I would check with your court or a lawyer and see what they have to say.

These people that are saying she is considered a custodial parent are WRONG!! The court DOES NOT see her as an equal in any way shape or form. Trust me! My husband's daughter lives with us and he is the custodial parent. We have been fighting over the grandmother's (unfit) visitation rights for a long time. Despite the fact that I am the SOLE supporter of his daughter, and have been for years (not a drop of child support and my husband, his lazy butt, stays home with the kids) I have no LEGAL rights. The court will not even allow me to SPEAK on her behalf when my husband goes. UUUGGGGHH! It makes me mad! I raise this girl as my own and do EVERYTHING for her (her mother the in and out of jail drug addict does nothing) and I can't have rights! PLEASE

Wow> I have no idea where those "yes" answers come from.
Remarriage of either father or mother has NOTHING to do with who has custody.. custody is between biological parents ONLY. And neither parent automatically has custody, that is determined by terms of a divorce.

No, the law does not consider her a custodial parent...She may be his wife but, unless she adopts the child (noting that your daughter is not in the picture) then she has no legal rights over your grandchild...

Yes, she can be a custodial parent depending on the situation. Once he married her she became equal. My husband I have custody of our children from his previous marriage. I have just as many rights as he does when it comes to them, if he and I were to dissolve our marriage then he would still be obligated to share custody with me. We checked on that prior to marriage once the former wife refused to let me adopt them. My lawyer said that for my state I didn't really need to adopt them any ways because of our circumstances the court will regard me as equal. I joined their lives when they were 2 and 4, they are now 7 and 9. But for some reason since day one I felt as though I birthed them myself.

No, she is the custodial parents wife. That is if your grandchild lives with them. The custodial parent is who the child lives with.

marriage does unit people, i would say yes.
when i got married the law recognized my husband as one of the parents. but then again, i heard that adoption was what makes a step parent your custodial parent, but when we go to court, they say what is the step father have to say...hmmm I would call a lawyer in the yellow pages and ask that question in the free consultation.
