It depends on a few factors. If they own the house they do not need to have any sort of license. They need a brokers license in most states if they manage the property for another owner.

If they are fraudulently accepting rent then you may be able to sue for all or part of it AFTER the criminal charges have been proven in court.

If your landlord is renting w/o a real estate brokers license you can report them to the housing authority.

some cities do require a landlords license to rent out a home. But not all. But even in the event your landlord requires one but doesnt have one, doesnt mean you get to live somewhere rent free. The only thing that will happen is the city will fine him and make him get one. Can you get your rent back? Absolutely not.

No..your not entitled to back rent. If the landlord is required to have a license or C/O, most states would just fine the landlord and give you a few days to remove yourself from the illegal dwelling. You are then free to sue the landlord for moving expenses.

No. I am landlord that owns a flat. I rent out half my house and live in the other. I do not have a license. The house is just inspected by the city every two years.

No, you won't get any rents back. The worst that can happen to this guy is that the city will fine him for not taking out a license, and then require him to obtain one. However, lack of a license doesn't mean YOU get to live rent free.

Sounds like Lady is trying to scam some money off her Landlord. Hey if you breath air on someone Else's property, can they take it all back if their hair is blue? Get real will ya! Or get a job, you've got way too much free time on your hands.
