should he rent or buying a house now, or he need to wait till the divorce is final? if he buy a house now can his wife get 1/2 what he put in for his new house?

RENT the house. Wait till the divorce is over and then buy the house.

Everyone's got a piece of it. In community property states, you need an attorney to help you. The wisdom proffered makes sense- even if it's "legal" to buy a house on your own, it might be better to wait a bit until the final decree.

I'm in California. My divorce was filed in January 2006 and was final in April 2007. My attorney didn't want me to buy anything until the divorce was final. (I bought a motorcycle, but my ex didn't want any part of that minor purchase.) If it were me, I'd wait to buy something else.

Better rent but if the divorce is all ready on paper it wouldn't make any different .Buying a house
takes a lot of paper work.If you just put a deposit
on it,and after divorce finalize it.
if he decided to buy now,she couldn't get it any way,what would she get.Not the house as it
wouldn't be dividable property.
the judge would probly rule,that he is entitled to
live where ever he pleases.Divorce papers says,
what she is filling for.Not what he buys during and after divorce.

I would rent until the divorce is final. That way there is no question of community property.

As soon as you file for divorce you are considered single in that aspect. His wife can not get half if he acquired the property after the papers were filed.

You should rent until the divorce is final probably. If you are unsure, ask your lawyer.

aslong as you filed, buy
renting is throwing money out the window
but
make sure the marital assets are divided up evenly of you will be forced to sell or pay the difference if the split is to be 50 50
