One of my friends drove home drunk (i begged him not to) and he had a wreck and there was another vehicle involved. This just happened last night so i dont know if the other person is hurt and i dont know if he is either cause he has his phone off. Hes been charged with a DUI a few weeks ago and his past isnt that good. Hes underaged (17) so what would happen to him? Is there a slight chance that he wont get sent off?

He gets to go to prison. A second DUI, is bad enough. But getting people hurt while commiting yet another felony, is going to be brutal. The prosecutor will probably throw vehicular assualt on top of the other charges.
Sounds like your friend is about to find out what real life is like.

I am not a lawyer........ however, his phone is probably turned off because he is in jail and he hasn't sent bond yet. It really depends on the charges when he will get out of jail, how large is bond/bail will be. In most states a 3rd offense is when charges become more serious, because of the pattern. Indiana, has laws that protect society, and take away privileges from the offender. If someone was killed in the accident they will charge him with manslaughter, and he will get out of jail, get a lawyer, however the likelihood of serving time regardless of his age, is great. As a seventeen year old, they will probably charge him as adult. I wish the best of luck to him, his family, to you, and to anyone else this may have affected.

Sorry I couldn't help more
