my friend got a call yesterday from child support agency in CO where her kids are. they said that they had not recieved a payment for about 8 months. she told them to call her employer cuz she's the one who has been taking it out of her check every 2 weeks . today my friend asked her boss if they called "no" then she asked about the garnishment and all her boss could say with alittle laugh "i'm broke and i havent been paying it." what can my friend do about this ??????

The person should have pay stubs that show the money taken out and his bank deposit receipts to the judge who ordered child support. This will prove to the judge that he is complying with the support order and that the boss is not sending the money. The judge will then order the boss to appear and to explain what is going on. When the judge finds out what the boss has been doing in violation of a court order, the judge can hit him right then and there for contempt of court, fine him or sentence him to some jail time. You can bet the boss will not do it again.

That is ILLEGAL!!! I can't see any employer doing that--but, there are some crazy people in the world.
I would call the child support office-- show them the proof that it was being paid(your pay stub) then, most likely- the child support office will do the rest.

Sensible is the only answer close to being correct.

I would also advise contacting the Child support agency AND the state Attorney General and file a formal complaint against the employer for misappropriation of state funds.

What your employer is doing is considered a felony in many states.

Tell her to photocopy her wage receipts and mail them to the Child Support bureau to confirm the company withheld the funds. Include the name and address of the company and the bosses name.

Call a lawyer and the cops!!! What your friend's boss did is illegal. Notify child support of what has happened.

Report the boss immediately to the department of labor (www.dol.gov) and state labor department.

Tell him to call the Colorado Labor Board. That is his money he is keeping from him.

call up the labor board.. it is unpaid wages.
