On the Headline News, Nancy Grace was talking about this woman who was driving her vehicle with her two children, and she was drunk. It is all over the news, she is looking at a year in jail. This is her second offense, same thing different day. However, if this was a guy who had drove drunk with his kids he would probably be looking at life in prison without the possibility of parole. The laws are so different for men than women. Did you know that when it comes to child support, a guy has to pay something like 44% of the average income in his state? If a woman ever had to pay child support to a man she only has to pay 23%. Where is the justification of that? I believe that the law looks at women as homemakers or something. Where is this equality that they sought when they wanted to vote? Why is their such a difference? In every aspect of life, from approval of a loan, to child support, to sex, to whatever, why is society like this, and why doesn't someone fix it?

I am in the process of writing a book about this imbalance in the judicial system. I am a woman, however I am a true believer in EQUAL rights. Did you know that most times when the state removes children from a custodial mothers home because they are found unfit, that they are put into a foster home with out the father being a consideration. For a father to get custody of his children it is a long battle, upwards of 6 months. If the reverse is found true, the children are almost automatically placed with the mother. Many other things go on....way to many to list here....I hear you.

Look. we all know that men and women are not equal and by their very nature, never will be. At one time women were put on a pedestal and were someones property and responsibility. When they recieved the vote and became emancipated, the lawmakers realized that due to natural, economic and cultural differences, women needed a leg up the ladder of life and wrote into the laws, a lot more leeway where females were concerned.I agree that in some cases today, the justice system , laws, courts and police are used by women unjustly or unfairly. Their sex is protected by the law. In todays society the law is the only protection for it. Extended family culture has disappeared. People move around easier. Family ideas and values changed.

If I had anything to say about it I would put them back on the pedestal and take away their vote and rights under todays constitution. Life would be much easier.

If what you wrote about the drunk driving is true, yes it is not fair. The woman who was caught drunk driving with her kids in the car should be given the same sentence as a man, everyone who was put at risk still faced the same risk regardless of whether it was a man or a woman at the wheel.

As for the child support, this takes into account that women don't make as much money as men, even thought the ERA says we are supposed to be.

Why is there such a difference? because it has taken this long to close the gap as far as it has been already. Remember when, back in the day, when women were chattel, couldn't vote, had to ask permission to travel, etc.?

(1) You have no evidence to back up your claim. If a woman OR a man was driving drunk with his or her kids, that person would be looking at serious prison time.
(2) Child support is based TOTALLY upon formulas set by the state based on (a) the income of the parent with primary physical custody, (b) the income of the parent that does not have primary physical custody, (c) the difference in custody time (i.e. if one parent gets the kid for 4 months out of the year, they don't have to pay as much child support as a parent who only gets his kids 2 weeks a year), and (d) the number of kids they have.
The explanation to the unsupported stat you gave, then, is that, when the mom is not the parent with primary physical custody, she probably had fewer kids with the father, she gets more time with the kids, and the FATHER's income is sufficiently high that he is required to pay a greater share to take care of the kids, even when he's the parent with primary custody.
If anything else, this demonstrates the economic disparity that exists in the workplace for women, NOT that women are treated better by the system. Gender plays no role in the amount of child support ordered by a court.

i agree with you that sometimes the law works in the favor of the woman. however, in the drunk driving case, no. i do not think a man would have gotten life in prison as opposed to a year for the woman. men pay more in child support because they still make more than women! it's just a fact. i don't think those percentages are coming from the comparison of equal salaries. it's probably just an overall average and men making more would make sense that they pay more.

The law does not treat women less harshly than it does men. The vast majority of law-makers are male. If anything, women get the short end of the stick.

And your "statistics" regarding child support are completely false. The amount of support is based on state guidelines. When establishing the Order, the non-custodial parent's income is plugged in against the custodial parent's income and that's how they arrive at the monetary obligation. The state doesn't consider what sex the non-custodial parent is.

Actually, a guy wouldn't get a lifetime jail sentence for drunk-driving twice. But I do see what you mean: The American legal system has a gender bias. I suppose the reason for the gender bias is because men typically commit more crimes than women. Men are also the "rougher" of the sexes. For these reasons, the legal system punishes men harder than women.

Is it unfair? Yes. But I don't worry about it, because it's not like I'm ever going to get into trouble with the law.

But did you also know that men are paid more than women? In this regard, wages are gender-biased, but biased in our favor.

I don't know what state you live in, but the laws in my state are the same for men as they are for women. I have never heard of anyone having to pay 44% of their earnings in child support, unless maybe they have 12 kids to pay for.
