I have a friend who has been sitting in county jail cause of not going to see his Probation Officer for two months. He was put in jail on October 5th and had Court on October 17th. He has a court appointed lawyer and the court said come back on November 7th. Can the NY Court System let this kid sit there like this? Original problem stemmed from him and his ex-girlfriend not getting along. The ex convinced him to go to court and make it sound like he was a monster, cause she thought Child Protective Services would take their daughter.

Probation is issued in lieu of jail. You sign papers that you understand and will comply with the rules of being on probation. If you don't, they return you to jail. seems it would have been easier for him to keep his appointments with his PO.

I'm not sure about NY state law but in Mississippi if he was arrested for Violation of Probation he might be able to bond out with a bonding company until the Court date in Nov. The Judge may have given him a Cash Bond which would have to pd in full before being released on bond. If bond was not granted then yes he can sit in jail until court date to assure that he will be present for the court date. As far as his punishment for Violation of Probation in MS it's up to 6 months in jail for the violation alone not including the original charge he was originally placed on probation for.
Your best bet would be to get in touch w/ the Public Defender if you are a family member they may be able to give you some info. on the situation.

If he's in violation of probation, he can be sent to jail for the entire length ofhis probation, so yes he can sit there.
