Ok, so here's the deal..he accidentally got some chic pregnant. he wore a condom and didn't even bust (ejaculate). Now she's claiming it's his.
He already told her ahead of time that he wasn't going to be invovled in anything, he didn't want her to go through with the pregnancy, he wanted her to get an abortion, he wasn't going to be in the childs life, etc etc. She said, she didn't need anything from him, money etc etc. That she was going to do the whole pregnancy/baby thing on her own without his help. And she didn't need him for anything.
He wasn't there throughout the pregnancy, nor was he there at the hospital to sign the birth certificate. There was no paternity test done either.
How is it that she was able to get a child support case without a paternity test, with no father on the cert. and let alone with all his information (ss#, DL #, financial information)? Is there anything he can do? What should he do? HELPPPPPPP!!!!

During the child support case he can contest parentage of the child. Your friend can explain the situation, though make sure it is done in a proper manner. The judge will then order a DNA test done before continuing on the case. However, he may have your friend pay for the testing. That is something that could happen. He needs to speak about his options with an attorney as soon as possible so the attorney can get the proper paperwork doing ahead of time, perhaps something even for a injunction.

he needs to get a paternity test done, if this child support case is through welfare they will pay for it although if it is his they might make him pay a little extra on his child support case. But anyway if not i think they are expensive but not as bad as 18 or more years of child support. If it is his well then he probably lied and is an idiot for wasting the extra cash. Oh well it seems like anymore women lie and men lie about paternity issues i feel sorry for the kid either way and hope that if it is his he is a man about it and is there for his child. In my opinion there are two different kinds of dead beat dads those who don't pay child support and those who refuse to be in their child's life. I have been through this my son's biological father insisted on paternity test. He has only seen his son a couple of times at a child support hearing, still refuses to sign the birth certificate but atleast he pays his support. Thankfully i met a wonderful man who i could tell really truly loved my son like a father would. Now when i think back on how hard the first year was sitting at the hospital with my son during a few of his surgeries alone it still makes me sad but i know that he has the best dad that anyone could have. I cry out of happiness now. We are hoping to go through the adoption process soon hopefully my sons biological father will sign over his rights since he doesn't seem to care. And we all lived happily ever after

Here is the deal, a paternity test will be done. After he receives the results he may at that time want something to do with the child. If he still does not and it comes back positive, you can ask the mother to relenquish your rights, basicly sign over custody of the child to the mother. But it sounds like she is in for the money and in that case you dont really have a choice. Depending on what state your in see what your options are, here in TX it solely rides on the mother.
This identical situation happened to my husband right after we were married, we now share custody of the child and it is great, it was just hard at first adjusting for everyone involved.

Get the paternity test done to make sure that he is in fact the true father? Then depending on the what the results show, he may end up having to pay child support? Good Luck with this situation :)

It doesnt matter if there is a father on the certificate or not. My first born I went through this, and he has been receiving child support for 13 years. He has to request a paternity test, and if it is his he will have to pay. No way around it. He told you he didnt ejaculate, but chances are he is not telling you the truth. Exspecially if he cheated on you.

She has a right to change her mind if she needs his help. She can file for child support even if his name is not on the birth cert. He needs to request a DNA test (which he will have to pay for) but, it will be worth it if it is not his. They will get the DNA test done, and if it is proven that it is his...he will have to pay a certain % of his income(usually 20%). He will have to turn over all his financial information to him - tax returns etc - so they know how much he makes. He has to do this - or risk going to jail - it is the government...they can do pretty much whatever they please..
SO, tell your friend..... Demand a DNA test --- And, then wait...

Uhh even though she says she doesn't need anything from him - guess what - the child is automatically entitled from conception to have parents that meet their basic, educational, childcare and emotional needs. So just because he does'nt want to be involved...the childs rights override the parents in this case. First take a paternity test to establish if he is the father or not. Then go from there. That why intercourse is for grown married adults who love each other and want to spend the rest of their lives together...so if you don't fall into that catergory - intercourse is not for you.

Yes, he can get a DNA test and if he he found to be the father he can pay child support until the child is 18.
P.S. It may not have been the woman who filed the Child Support case. If she ask for welfare or medical care for the child the state would file the case.

it doesnt matter what he told her about being the babies life or if he wanted it or not, he is still held responsible even if he pushed for termination, it isnt his decision, with that said, I know that in the state of MASS if a parent sarts child support proceedings and is not married to the other parent the court automatically orders a DNA test, at which time the father can waive or accept, he is not held responsible for the test unless he is proven to be the father.

He needs to take her to court and he will have to pay for a DNA test. If it IS his baby he WILL have to pay child support even if he doesn't want to be involved in the child's life, which is not fair to the child. This is what happens when people go around having casual sex. Innocent babies are created and they deserve better! He needs to step up and be a man if this is his child!
