Is there any way to get out of your license not being suspended for a minor in possession? I've read that the penalty is one year, I was planning to move back home to Nevada in January but cant do so without a drivers license. Also my current drivers license is Nevada issued, could this have any implications.

It is important to remember the drivers licenses are not really suspended, what is suspended is the driving privilege. As I understand it, a MIP conviction will result in your privilege to drive in California being suspended. However, this does NOT necessarily result in your privilege to drive in Nevada being suspended, unless Nevada has a corresponding law. Even if they do, since this is not a traffic violation, the Nevada licensing authorities may not learn of it.

That said, I understand that many California counties have programs for first-offenders which will result in dismissal of the citation without a conviction, and thus without a suspension.

You know it is very amazing to me how many minors get hold of alcohol, and for what purpose is it for ,hey I from Australia so in my mind you and at what age do you call a minor there I know the age limit is 21, and that is very different from here ,but if you were here, and that you were in fact the minor and also in possession of alcohol, you see a minor is only on a learners licence , until they pass the next stage to gain a higher grade of licence. it goes like this

L = Learners age ( 16 + 9 months ) restricted 80 k zero alcohol , you cannot buy alcohol only when you reach the age of 18

you must hold the relevant grades for 12 months or longer
P1= next higher grade restricted 90 k age is from 17 to 21
P2 = same as the above
Car = not restricted speed limit 100 k

any alcohol infringement during L + P1+P2 and speeding means that you lose your licence for 3 months is the minium, and then you have to pay the fines that you are hit with for doing something wrong.

So each country has different laws, and it pays to obey those laws.Break the Law, you know that you have to pay the penalty for doing so.

States now share BMV records with other states. If your pulled over in Nevada, you will be arrested on driving while suspended. You will also not be permitted to renew you license until the terms and fines are paid in CA. You may want to get an attorney.

Kind of a confusing question. Was the minor in possession of your car, license or alcohol? Sounds like the court decided you were a factor in the possession. Not likely you will get it back without a court battle.
