Earlier this week, my friends and I were enjoying a friendly game of poker. One of my friends who was at this game is a girl, who I actually attempted to date a while back, before learning that she was a lesbian, and her girlfriend.

Thinking that their four tens (four of a kind) would be a winning hand, her girlfriend suggested that my friend sweeten the pot by adding that the looser would have to give the winner oral pleasure and my friend placed this bet.

I was the last one in the game at this point and believing that it was unlikely that they could beat my straight flush, accepted this bet and won this pot.

While my other friends, myself, and her wanted to settle this account immediately, her girlfriend insisted that she was too drunk and whisked her away.

The next day, I told my friend that she didn’t have to do anything she didn’t want to. She then asked me if I would have done it for her and, when I said ‘yes’, she said that she’s the same way. Furthermore, she said that she’d guarantee that this is going to be “the best head I’ve ever received” and said she’s do it on Friday!!!

Earlier today however, her girlfriend, with whom she has an open (for girls) relationship, called me up and demanded that I not let her do anything and insisted that, because she was having sex we me to ‘pay off a debt’ that it would be considered non-consensual and would amount to rape. I told her that her girlfriend didn’t have to do it and she demanded that I never do this with her girlfriend and threatened that, if I did, that she’d call the police.

Given how she was the one who told my friend to place this bet, I find her attitude especially annoying.

I am curious however to learn if her assertion is true in any way.

Out of curiosity, both with and without the “out” I gave my friend, would collecting this physical reward be illegal in any way???

BTW; On Friday, if things go as I hope, I plan to ask her if she wants me to return the favor.

Well...if she is willing, i cannot see how it is considered rape in any form.

It may be however, considered prostitution or solicitation.

Personally...sounds to me like she wants to do it and is using the bet as an excuse.

Since you consider this person your friend I think the best thing would be not to try and collect on this bet. If she wants a relationship with you she'll come to you at some point to settle up. Consider though that things will not be the same afterwards. I don't think this is a legal matter as much as an ethical matter. You seem to be a well spoken and intelligent person, is a few minutes of sexual pleasure worth all the upset this may cause?

Lots of these answers seem to relate more to US law, so since you have posted on Yahoo UK I will give my viewpoint as a UK citizen.

I think it will definately NOT be automatically defined under any kind of rape law. As long as you have taken steps to establish that she consents of her own free will, it is completely legal as long as she is of consenting age. (16 in the UK)

It may be a sticky situation under some prostitution laws however.

The easiest way to get around this is to have a long talk with the girl who is supposed to be giving you the oral sex, not her arsey girlfriend.

If she wants to go ahead, ask her to sign something that says she is doing it because of her own free will, and NOT IN CONNECTION with the bet. Even if it is, if she has signed that and she and you both insist that it's true, then there won't be anything anyone can do.

The only thing is - I think you should be aware that if you do this, her girlfriend will probably break up with her. Do you want to be responsible for that? If she is a lesbian, it is unlikely that the two of you have a future.

I'm assuming that we're talking about an adult woman here. If she's younger than the age of consent then it's statutory rape under any circumstances. Otherwise, I would be more worried about it being considered prostitution than rape. If this other girl calls the police they most likely will blow it off as a jealous girlfriend. There is a chance that she could be getting both of you in trouble for solicitation and prostitution though.

The gambling itself is legal, unless the house took some of the pot money. But as long as she consents to sexual contact, you are OK. But may I suggest not accepting bets like this in the future.

Hard to say if a rape conviction could happen as each states has different laws as to what constitutes rape. I think you would have more problems with prostitution laws as prostitution is normally defined as having sex for money, goods or services.

Since you are gambling which is illegal in many states, and asking for oral pleasure which is illegal in some states and having sex between unmarried individuals which is illegal in some. Plus it will be considered rape.
So unless you like 15-20 years with Bubba and the boys..you might not what to try to settle up on your winnings

It would not be illegal unless it was forced or one of you was under age( being eighteen or age of consent), otherwise it is perfectly legal. On the downside however, whatever goes around comes around, so if karma or whatever you do or don't believe in comes around and brutally *** rapes you, you'll know why.

First off - if your friend is over 18, then anything that happens between the two of you is consentual. The GF is just pissed that they lost and she has to give head to a guy.

Make her pay up and if you can get something, then go for it.

dude if she down for it no its not illegal
her girl is just mad cause she wants to do it
there is no way in hell that u can get in trouble
i mean u can force intercourse(rape) but its kinda hard to force a female to give you head she could just bite it off
so no ur in the clear have fun with her
who knows maybe shell leave that ***** than ull have a girl that like girls and you even better
