I am pretty sure you don't get to choose how much he pays in child support. Texas is where we live and here your child support is based on a % of the last 3 months pay.
As for the pension you need to check with the law in your state. Texas is a community property state. All earnings before marriage are not subject to division. Only moneys earned after marriage is subject to division. So check with your state every state is different.
Disagreeing is what makes divorce so expensive.

You could also go up to the child support office- and have them start a case on this... thats what I did when I got divorced..started a case..and then did the divorce part. but, you said you also can't agree on the pention..so, if you can't agree on that - you would have to take a diff. route.

Your childs father is refusing to take responsibility. Get a lawyer. Surely he must know that this isn't going to go in his favor. You will get the kids, support for them, probably everything in the house, the cars, his bank accounts and maintainence. Why would you choose to let this loser off the hook?

Why dont you talk to him and resolve the problem. Separation wont help child first. Even then you may have fiel a case against him.

WHEN MY EX AND I DIVORCED, WE AGREED ON EVERYTHING TO EXCEPT CHILD SUPPORT. I DIDN'T HAVE AN ATTORNEY AND HE DID, THE COURTS MADE HIM TO PAY CHILD SUPPORT EVEN THOUGH HE DIDN'T AGREE. Take this to court, he is the father so he should be paying. he is not divorcing his children just their mother, they are still his responsibility and he needs to be reminded of this.
