If you don't show up in court there will be an automatic judgement for the landlord. You will at least have a chance to defend yourself in front of the judge.

What 30 days?? Who says you get 30 days for anything?

You have 4 or 5 days at most to answer the suit. If you don't respond by the date in the subpoena, the landlord gets a default judgment against you and that's pretty much the end of it. Depending upon state law and local procedures you can expect the sheriff to arrive within 3 - 10 days after the judgment to put you and your things on the curb.

The whole process, from service to the date the sheriff arrives may take around 30 days or so but the clock is already working against you. If you were served on the 15th and have not responded to the suit it's probably too late to do so now. Check with the Clerk of Court TODAY if you intend to contest the eviction, otherwise you'll be on the street shortly after the 31st if you haven't made alternate plans by then.

Likely the 30 days begins after the court order. The legal documents will telly ou if you take the time to read them. Talk to a rentors rights attorney. You should have done this long ago. Now you are faced with getting out on time or being locked out by the Sherrif or Marshall.

If you don't show up for court ther e will be a decision made in your absence. If you think you can play more games than you already have - you are on the road to a Very Rude Awakening. You could have taken care of this when you had time. Now it has gone to the last legal point.

By the way, If you have been supeoned and you do not show up you can also face contempt of court.

Best get going. You are fast running out of time and the consequences are going to be serious.

Present your case to the Judge. He is human. Unless this has gone too far, maybe you can make an arrangement. It is, however, up to the Landlord to accept.

In an eviction you are no longer afforded the 30 day rule. The judge at the hearing will determine how long you have to stay. Most state it's usually 3 to 5 days before the sheriff comes to haul you and your stuff to the curb. BTW...good luck renting elsewhere with an eviction on your record.

Yes you always have to show up in court if you have been subpeonead. The 30 days is from the date of the eviction notice.
